MASSIVE pants

Hi,
I have just bought hubby to be a couple of pairs of silk underpants from a marketplace seller on Amazon. When they arrived we took them out of the packet and they are massive. Naturally, I would like to return them, however when I go to the Amazon managed returns process, it states that my product is ineligible for return! I have checked the original listing, and this policy is not stated anywhere. I have tried contacting the seller - no response as yet. What are my rights here? Happily they appear to be a UK company.

  • This depends on the reason for the return - if they are not as advertised (i.e. the size is not as stated) then you should contact the seller directly through Amazon, if this fails then open an A-Z claim.

    If it was a case of ordering the wrong size then you may be out of luck as they may not be returnable for hygiene reasons.

    Their returns policy is shown on their terms and conditions page,
    and when checking out, the following appears (the link goes to their T&C's)

    For your health and safety, lingerie is generally not returnable. Those in their original sealed package and show no sign of wear or use whatsoever may be returnable. Determination of use is made by The House of Silk Emporium staff ONLY.

    Current distance selling legislation (the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013) does allow for returns of opened goods to be refused where hygiene or health can be an issue, so it looks like the retailer is correct in this instance.

    I can't see the returns policy anywhere on the Amazon listing which is where I bought them from. Clicking on the returns like takes you through to the standard Amazon help page, not a specific statement about their own policy...

  • You need to click on the seller information to view their policies. They must detail their own policy and cannot rely on Amazons policy (which is aimed at their own direct sales customers).

    All sellers on Amazon Marketplace must offer a policy that at least matches that offered by Amazon. If all else fails open an A-Z claim by finding your purchase in your purchase history and clicking the file a claim button.

    I can't find the seller information on Amazon :-(
    If I click on the seller link, it just takes me to a listing showing all the items that seller has for sale. Any idea how I find this information?

    Click on the sizing chart and see what the size is in inches.

    Measure the waistband and see if it matches up.

    I returned a pair of jeans once as they were labelled as 30 inch waist but measured 37. I had ordered 30 inch waist and as far as i was concerned they were not labelled correctly. I got a refund no problem (and no they weren’t hipsters so I wasn’t comparing waist to hip measurement)

    - Log into Amazon
    - Click on Your account then Your orders
    - Find the relevant order and click on the sellers name where it says Sold by: xxxxxx
    - You will see all of the sellers items. On the left under the sellers rating you will see a link 'Detailed seller information' click this

    You should now see everything about the seller, including their terms and conditions.

    The DSR used to include underwear (despite popular perception otherwise). Not sure about whatever regs have replaced them though.

    However, if they're clearly not the size stated, the SOGA is the appropriate legislation anyway.
