failed iva
Hi guys long story short (ish)
Rbs have charging order £22,000 (always paid never missed )
Iva for various other debts appox 12,000 possibly less
Took iva out jan 11 they suddenly upped my payment from 100.00 to 160 stating my partner could afford the extra. I had a long battle amending this as my partner keeps his money separate as im awful with it!.
Anyway last year Halifax paid £2100 into my account for Ppi and I spent it (seemed a good idea at time as my partner was off work ill and we had very little income) anyway my iva has now failed due to this.
My mortgage is 97000
Charging order is 22000
House worth115,000
= 13,000 equity at max 1/2 = 7500 as joint
So I quite prepared to re do dmp as was my first idea not iva, I think I was rather pushed into (lots going off at home at the time I don't think I was quite myself at the time). There's no equity in the house so bankruptcy isn't an option as none of iva creditors would benefit!
So dmp is my way forward I think? Is there anything I need to ask iva people?
