Harry potter platform 9 3/4 shop

My daughter ordered a Timeturner in a display case from this place ,when it arrived its bloody awful they say its 24 carat plated but it feels and looks like cheap plastic .I returned it for a refund but they are being awkward saying as its jewellery it cant be refunded.
It cost £59-99 but would be over priced in a pound shop.

Any ideas on what to do if they refuse to refund ? the original purchase was via paypal.

How long after delivery did you contact them to say you want a refund? I have no idea what a Timeturner is, but they cannot refuse a refund simply because something is jewellery. If it has hygiene seals that have been removed then that is different.

I'm not aware of any restrictions on Jewellery refunds unless it is personalised or body jewellery which this doesn't appear to be.

Their returns policy is very short but does contain the phrase "Please note that jewellery items are non-refundable" which I would state is contrary to your statutory rights under the Consumer Contracts Regulations

its in the jewellery collection and the returns section on the product page state

We want you to be happy with the goods and service you receive and so you have 28 days, from receipt of goods, to notify us if you wish to exchange an item or simply return the product for a full refund. Please note that the refund will not include the original delivery charge.

To return an item please find enclosed returns slip and attach to the outer packaging. Simply return your parcel to the post office making sure to get a proof of postage. Please include order number where possible.

However I woud still says with the distance selling regs they cant add that caveat for your right of return.
What is the timescale from ordering to return?

The returns policy is so sparse the company must be unaware (or doesn't care that) there are laws they need to follow.

To be clear:

Just because the seller has indicated no returns for Jewellery this doesn't mean you cannot return them. The exceptions indicated under CCR which refer to this are specific to body jewellery where returns may not be accepted for hygiene reasons or personalised jewellery where resale is not possible.

In this instance the seller is in breach of CCR if they do not accept the return.

For any communication with the seller it is worth pointing them towards:

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, No. 3134 Part 3 Regulation 28

This states the specific cases in which goods cannot be returned for refund within 14 days including:

the supply of goods that are made to the consumer’s specifications or are clearly personalised;

in the case of a contract for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if they become unsealed after delivery;

Your item does not fall into these two categories therefore acceptance of the return is obligatory.

Thanks for the replies - It was received on Saturday and I emailed them the same day and returned it signed for on Monday.

They have said they are passing the complaint to a manager now but once I can see its been signed for I will contact them again for a refund.

That one states 18k and is £1.20. With no statement of gold plate they are as little as 76p.

They may not and you'll find it's returned to you. 'Signed for' just flags up 'complaint' to these type of Companies.

81p. Bargain.

I have a time turner from Ali actually and it's ok. I'd be amazed if it's been anywhere near any gold but for the money you can't complain.
