I purchased from m&s outlet online and want to return items within 14 days free of postage they are refusing to pay my costs is this legal? Their website as no but surely you have the opportunity to try on items and ironically the sizes were an issue ended up buying different suit but same size from their outlet bricks and mortar store that fitted.

Distance selling regs no longer apply (scrapped in June) and replaced by Consumer Contracts Regulations.
If the goods are faulty then you don't pay to return. However if you have simply changed your mind or having a size issue (not a fault with the product as such) you have to pay return postage (as far as I know).
So M&S seem to be correct.0 -
What do you mean by "pay my costs". You are entitled to a refund (incl the original postage) but you must pay for the return if their T&Cs state so. Also, the DSRs have been replaced by the Consumer Contracts Regulations (2013).0

You don't get free returns postage if the T&C's say no in the correct format, you do however get the original postage back.0
