We had a plumber in to replace a bath that we accidentally cracked in our rented house (landlord was informed and let us arrange plumber, bath had just emptied and no significant water escaped). The plumber failed to put any sealent on the overflow outlet and there was a gap plenty wide enough to get a fignernail in underneath the outlet (unbenkown to us). When my wife got into the bath a few days latter a not insignificant amount of water escaped into what she thought was the overflow, but turned out to be underneath the bath. It has now created several water marks on the ceiling below.

Are we within our rights to demand the plumber makes good in the room below, the landlord will withold our deposit to do so if we move?

    Two issue here:

    1. Yes, sounds like the plumber didn't finish the job properly so he should return to sort the bath out. Whether that's your responsibility to arrange or your landlord's I don't know.

    2. I don't see how you could be held accountable for the ceiling damage. Make sure to take photos and tell your landlord (in writing) that this has been caused by the failed plumbing job.

Tricky. Had the landlord arranged the plumber the situation would be a lot easier. Your plumber could just refuse.
