Court Paperwork Advice

Hi

I have now received my Notice of Allocation to the Small Claims Track paperwork from Oxford County court.

I'm just after some advise on what they are requesting.

I am requested to send to the Court and Defenendant:

a) a schedule setting out each charge for which repayment is sought showing the date, amount and reason given (if any) for that charge

So basicaly do I just need to compile a list of all my bank charges with dates and send to the court and my bank?

b) copies of any statement or other document relied upon as showing that the charges have been made

I need to make a copy of my statments dating back 6 years that my bank supplied me with and send to the court and bank?

c) witness statements, documents and any other evidence relied upon in support of the claim

I'm not really sure what I can supply for this?

    You are right as to what is required for a and b for c that would be your evidence that you would be presenting. This would include things like the regulations that you say the banks are in breach of and any cases that you say support your argument. If you contact penaltycharges.co.uk explain that you have this case and see if they have a copy of the judgment in Terry v LloydsTSB Plc from the begining of July. Also although it does not assist your case to show the court that you are being fair put in a copy of Berwick v LloydsTSB. If you were intending to give evidence a copy of what you are going to say but not arguments as to why you say you have a case.

    I hope this is clear.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    I registered at penaltycharges.co.uk a little while back but I don't seem to be able to post new threads for some reason. I will try again later

    I'm in two minds now to accept the banks offer as I didn't realise that on top of the £120 fee for the MCOL I would also have to pay a £100 allocation fee.

    I don't really want to be a further £100 out of pocket if there is a stay and I don't get a result until a year or so's time.

    That said i'm very unhappy with Barclays and I would like to see this through and get all my money back!
