First Direct Default on Current Account

Evening All

I had a current account with first direct and they gave me a default BUT i was within my overdraft limit and wasn't overdrawn.

Are they allowed to give me that default or should i try defend it?

    Have you queried them yet about it? Maybe there's been a breakdown in communication somewhere and they'd lowered your overdraft limit or something?

    Yes i have spoke to them but they refuse and it was only last night I noticed that they did low my credit limit from £500 to £190 but the default was for £176 so i was still within the credit limit. Also i did notice on my credit file that they reported lowering the credit limit after they issued a default.
  • They refused? Did they explain exactly why or how you've defaulted? Maybe double check all your recent transactions?

    Without knowing the full background to the story it's impossible to comment. Defaults rarely come out of thin air. There's a cause.
  • Write to them, stating you don't believe you defaulted and require an explanation.

    See what they say.

    Today i got all 3 credit report's to check the info and they all report the same regarding this default. There is no evidence that i should of been issued a default and i am going to copy all 3 reports and a letter to First Direct asking for this default to be removed due to incorrect issue of default.

    They did remove the credit limit on the OD to £0 but that was only for 4 months so they would only get 4 months over limit and then put limit back on account higher than the balance.

    I dont know BUT i do have all paperwork they hold regarding my account and i will be going through it all this weekend with a fine tooth comb so i know exactly where i stand before sending a letter to them on monday
  • UPDATE: I have looked through all the paperwork and came up with the following:

    on 29/11/11 my account balance was -£475 overdraft £500
    01/12/11 made payment £10
    28/12/11 made payment £150
    02/04/12 made payment £200
    30/04/12 made payment £100
    31/08/12 they issue default

    On my credit report like i previously said, they removed the overdraft limit to £0 for 4 months between March 2012 - June 2012 then in july 2012 the limit went back to £190 and the balance was £173. In august 2012 they reported as the balance as zero.

    Any advice would be good, thanks

    Are you saying this is related to your account from 3 YEARS AGO?


    But you had only repaid £460 from a £475 overdraft. So hardly suprised they issued a default.
