Talkmobile Credit Rejection issue

Hiya,

I just applied for a talkmobile sim only contract, and the application was rejected. I have a 5/5 rating in noddle, so I don't think it was rejected due to a poor credit rating. I'm 99% sure this because the website never asked for a billing address (just a 'primary'/delivery address). I'm my case this differs from my card address.

As I understand it this rejection could leave a search mark on my credit rating. I've checked noddle today but I think it takes 30 days to update so not much use. I rang talkmobile and they said I'd have to talk to the credit agencys, but couldn't tell me which one was used for the credit check. From my perspective, this seems an issue caused by a poorly written website, so not my fault, but I'm not sure what the legal stance would be on it.

Does anyone have any advice on what I should do? I can reapply with the primary address as my billing address, but I'd be concerned that this wouldn't solve the original 'search mark'.

Edit: replaced 'black' with 'search'

There won't be a black mark, just a record of a search being done. They do not show if accepted or not, although they could guess in a few months time when they see no account being reported but have seen a search

So I wonder whether I should just reapply with the correct billing address (as I'm very confident this will go through) as then companies looking at my credit check would then see two searches and a new account. I could then later file a 'correction notice' via noddle on the first search saying that it was not my fault, but an issue with the talkmobile website?

    You've dodged a bullet.

Without exaggeration or agenda, I can comfortably say TalkMobile is the most inept company I have ever had the misfortune with which to deal. Ombudsman Services have taken up my concerns, found overwhelmingly against TalkMobile and yet are now battling TalkMobile to have them implement the terms of the Ombudsman's findings. I really, really wouldn't apply again to TalkMobile.

    What did they do wrong?

On a side note, I just read Martin advises not to reapply in quick succession as it makes you look desperate for credit, so maybe I should wait a month or so if I do re-apply.

I'll cut a long story short.

In July 2013 there was a period during which TM accepted they weren't able to provide service to me (approximately 3 weeks). Under their T&Cs continuous non-service in excess of 7 days permits unilateral cancellation on notice. I served them with notice and they immediately instructed a debt collection agency to begin harassing me (before any debt had even accrued). OS agreed it was harassment and nothing more.

I then severed my DD after TM accepted they had notice of my severance of the contract. They instructed a second debt management company. OS again agreed this was unfounded harassment.

Despite warnings from OS, TM then proceeded to enter a "default" on my credit file despite it not being a delinquent account. OS adjudicated and told TM to remove any adverse credit entries and refund me £50 that I had paid in satisfaction of my bills to the end of the contract (I didn't shirk any payments). TM took two months to refund me £50 and still, almost 3 months later, still haven't removed the adverse credit entries (the only mark on my file, preventing me from getting a credit card or new bank account at present).

OS are presently liasing with TM and have found nobody who is able to deal with this regularly. Instead, like me, they have been passed between ignorant departments and failed to get a resolution. Owing to the damage TM's actions are doing to my credit file, I am on the cusp of filing in the small claims court for damages. They have failed to implement a single one of OS's instructions.

I see thanks for this. The TalkMobile people I talked to on the phone also weren't empathetic to damage they were doing to my credit rating via their failures. I think I might just fork out the extra £3 a month for Giff Gaff.

Still not sure what to do c.a. my credit rating though

There is nothing for you to do.

You've requested an account, they've considered you application and decided they don't want you as a customer - end of story.

No black mark, just a credit search that you agreed to.

The address probably was the problem.

I ordered an O2 SIM from e2save a few days ago. I would have preferred to have it delivered to my parent's address.

During the process I was asked where I would like my order delivered: "Please let us know when and where you’d like your item(s) delivered". This is poorly/incorrectly phrased. It's not clear that you're suppose to give the billing address to be credit checked here. Checking the page carefully I saw there was an additional checkbox to tick to have my ordered delivered elsewhere, and only registered business address can be specified:
    Alternative Delivery Address

We are able to offer delivery to your place of work, however this MUST be a registered business. If you request this we will need to carry out some additional security checks to make sure your order arrives safely. This may cause a slight delay to you receiving your order. You will also be fully responsible for your order at this address no matter who has signed for it when it arrives, so it is really important you make sure this address is secure. Please enter the name of the company to deliver to when entering a works address.

Your exactly right, seems like the same issue; it seems very unfair.

That may be the case, but don't I have a right to know why it was rejected? And if its rejected due to a failure in their administration, don't I have the right for this check to be wiped/ the application to the accepted?
