livid!

4 - 5 times a day i am getting a call on my landline form capital one fir a woman who does not live at my address. I a have politely asked them to stop. Each tine they apologise and say they will but its still happening. Same time each day, i am at my wits end with them. I told them we have had no correspondence from them for this person so its obviously the wrong number. Im sure this can now be classed as harrasment!!

Ask for their number and then report them to the Ofcom. Here's some useful links https://www.google.com/search?q=reporting+nuisance+calls&ie=utf-8&oe=utf-8

Call the operator and report it to them. The operator will then screen your calls and screen these out.

Get in touch with your phone provider and ask about call blocking. Many, including Talk Talk and BT will give you a code to enter when an unwanted call has ended, this blocks all calls from that number. Simple.

    Are you registered with TPS?
If so, tell the caller, and report them.

Ofcom regulate telecoms companies. This is a data issue and the OP needs to report Capital One to the ICO, not Ofcom. However, you can't report a company to the ICO until you've following the company's own complaints procedure and received a deadlock letter.

Capital One are in clear breach of failing to maintain accurate records. Despite the OP telling them that this number isn't associated with their client, they've clearly failed to update their databases. Write to their complaints department with as much detail as possible - times of calls, name of the person they're trying to reach - and advise them that they must update their records immediately and cease harassing you. Advise that failure to comply will result in your reporting them to the ICO. Capital One will also be regulated by the Financial Conduct Authority and it might be worth reporting to them as well.

You also need to check your credit file, OP to make sure that this person isn't linked to you in any way. It's probably just that she's given your number, either deliberately or accidentally, but it's wise to check just to be on the safe side.

Or get your service provider to block the number. In my experience this isn't always straightforward - you have to prove harassment, or you have to pay, or you're advised it's not technically possible, or the company uses a number of different numbers so you're continually chasing your tail, or the person has deliberately used your number for all their correspondence so as to avoid detection and you start getting calls from lots of companies/debt agencies. Even if this is successful, I'd still advise checking your credit file.

Or just get a phone with call blocker / trueCall. Problem solved.

Yeah, they deffo help. I'd still want my details dissociated from someone with debts though. What next? It's passed to a debt collection agency who find out the address from the number and turn up to intimidate you? I hate anyone knowing legitimately knowing my number, let alone a company who erroneously thinks you owe them money.

Also, if they withhold their number and choose to stay on the line then Truecall won't help. Unless you block all withheld numbers, which you might not want to do.

Isn't TPS for stopping unsolicited (ie marketing) calls. It may not be a call of that type; it could be chasing a debt or something and that's the number Capital One have. Therefore TPS won't help in this instance unfortunately.

Like someone else suggested, I would follow Capital ?Ones own complaints procedure.

Their website outlines the procedure. Unfortunately they don't give a phone number though.

  • I am fuming a Cap1. My Father was rushed into hospital today. My Mother went with him and rang me from the ward. I arranged to try to come there this eve (I'm disabled so it takes me a while to arrange things). Mum said she would phone me to keep me updated. Thevphonr rang, and heart in mouth I answered it ( I should say that Dad is in his 80's) so I was expecting the worst.

It was Cap 1. I said that I could. It talk to them right now and could they pls get off the line as I was expecting a very important call.

They did not want to so I hung up.

A short while later, they called again. I repeated to them that I was expecting an important call from the Hospital and would they stop ringing.

Well you've guessed it. 1/2 and hour later and it was them ringing yet again. Some Indian chap who I could not understand anyway. Well I'm afraid I lost it and screamed a few choice words down the line and hung up.

My point is though, I thought that they could not cause harassment to such a point where the person they were ringing got stressed and felt victimised or some such phrase? Has anyone else had these endless calls. Btw. I am overdue a payment of under £29 by about 3 days.
