Another unfair parking charge

Hi all,

New to this, but saw a posting inviting new 'victims' to post so here goes.

CP Plus issued me with a very official looking charge notice on 21st Jan 2015, after I left my car at the Roadchef Chester Services to car share on a trip with a pal. My car was left there for three and a half hours, with a free period of 2 hrs. I - hand on heart - did not see their signage. It was 7pm, raining, dark, and I was looking for my pal, as well as trying to drive safely. My pal didn't see any signage either!

Unfortunately I 'appealed' before I saw all the advice on MSE. Wish I hadn't, but now I'm at the appeal to POPLA stage. I've gleaned loads of info, and a few winning letters to POPLA from here and elsewhere, so I wondered, if I post my 'challenge', could I have a bit of advice before I send it to them?

My hubbie thinks I should just bite it and pay up. But I've genuinely been taken by surprise by this, and I can't bear it when we're being fleeced by big uncaring, cynical profiteering.

    The template POPLA appeal is in the newbies sticky, adjust to suit and send.

    Do not say "I did not" etc, its "The driver did not"

    Whilst the amount may well be unfair, do you think that is fair to park on somebody's land and swan off somewhere else. You are abusing private land.
    You never know how far you can go until you go too far.

    Accept your principle totally, The Deep. What I object to is not having been given adequate information to make a CHOICE of accepting or rejecting a parking charge, and parking accordingly afterwards. I'm not in the habit of abusing anyones private property. In the past we've left our cars in pub car parks on the understanding with the landlord that we drink in the pub afterwards.

    And yes the amount is unfair and unreasonable. When the charge is £90 for overstaying welcome by and hour and a half on a dark cold night in an empty car park, when the charge for a full extra 24hrs is £12 (which I have offered to pay).
