Barnet Council ticket for parking partly on footway

Last night I was parked in Mill Hill (north London) circa 8pm on a rather tight road so I decided to park with two wheels on the pavement outside my friend’s house. No signs around with any restrictions and after 18.30 cars can park on the road. I came back at 10pm to have a ticket on my windshield from Barnet council saying ‘Parked with one or more wheels on or over a footpath or any part of the road other than a carriageway (partly on footway). As a result they’re fining me £110 (£55 if paid within 10 days). It says I can challenge the ticket if I so wish.

Do I have a decent chance in successfully appealing this? There were no signs up, it was after 6.30pm and the whole thing seems targeted and nasty at that time. Keen to hear if and how I should appeal. Can I claim I wasn’t driving the car?

  • Parking on the pavement is illegal in London, unless otherwise signed. So, on the face of it, you're "guilty". However, there are a lot of other things the council must get right in order to enforce the penalty, and many don't jump through all the hoops correctly. Not being the driver doesn't help, as it's still you who is liable.

    It's worth you asking the experts on Pepipoo in the Council Parking Tickets & Clamping and Decriminalised Notices forum. You'll need to post up all the information, including a redacted copy of the PCN.
