Odd Land issue.

Hi all,

far along in the process in buying the house all that stops us from exchanging is a odd land ownership issue. The back garden which is a couryard and at the end there is a shed which runs parellel to the terrace of houses and is split bwetween differnt properties. The property we are looking to buy owns the shed but not a small piece of land (maybe 3x1 m) between the garden and shed meaning it may be an access issue. Funnily the vice versa is true of the neighbours (we would potnetially own a shall piece of land between their garden a part of the shed). Confused? So are we and was if anyone wondering had a experience of anything similar?

Woudl it just be best to take out indemity against future issues?

    1) Who owns the land between your courtyard and the shed. Do a 'map search' at the land registry

    2) do you have access rights over the land. Check your title Deed

    3) is the land included/excluded in your Title Plan?

    3) What do you mean by "we would potentially own a shall piece of land"? 'Either this neighboring land is, or isn't, included in your Title? Is it? Is it included in another Title? (map search)

    4) Does your Title say you have access rights over the neighbouring land?
  • I am wondering what the layout is and am finding it a bit difficult to picture it.

    Reason being that my thoughts are going around the possibilities of doing some land-swopping, ie you swopping the bit of land your neighbour owns on with the other neighbour and so on. I cant picture if this is a possibility or no, but am wondering whether some judicious land-swopping would mean everyone would own the access land to their own shed, as well as the shed itself iyswim.

    Is the layout such that it would lend itself to that?
