    OP, follow the Shelter guide to reporting repairs. You cannot start withholding all or part of your rent at this time otherwise you'll fall into arrears so keep paying your rent.

    If you receive post for the LL either forward it to the LA or write, "Not known at this address, RETURN TO SENDER," and stick it in a post box.

    You don't have to answer the door or let anyone into your home if you don't want to. If you're getting bailiffs turning up it might be a good idea to keep some ID close to the door so that you can prove you're not the LL.

    No, im sure you had plenty of time - as usual you just didn't know the proper advice to give and gave the same amateurish, half baked, destined for trouble guidance you insist on palming off as fact.

    I meant if you don't have a UK address for the purposes of serving notice, u can withold rent.

    which is erroneous advice and missing the important caveat mentioned by the poster pixie. Funny how you always say 'well thats what i actually meant!' AFTER you're pulled on your dodgy advice, eh?!

    Yet again you've regurgitated something you've seen one of the more knowledgeable posters on here say, missed a vital condition attached to said advice and passed this half baked parrot style nonsense of as gospel. Why not just leave the folk who know what they're talking about to respond instead of potentially getting people into trouble through your lack of knowledge?

    3 letters + copies:

    As advised, put everything in writing to the LL, by letter, to the address provided (usually on your tenancy agreement) for the serving of notices.

    Copy the agents.

    List the repairs/defects. Use the sample letter in the Shelter guide.

    Write a seperate latter (LL & agent) advising the LL that the sofa will be put into storage, at the LL's cost, if not removed by xx date. Remind him of the agreement to remove by Christmas. On xx date, pay for removal, storage, and deduct from rent (when paying the reduced rent, write again explaining why and enclose a copy of the relevant invoices).

    Also write (letter) to the agent as anselld suggested requesting the LL's actual address, and quote S1 of the 1985 Act.
  • have you considered NOT dumping the furniture but returning it as unwanted to the landlords agent, a couple of photos is good evidence - that way you haven't disposed of it, merely returned it, you would of course have taken it to the landlord if you had an address !!


    I don't know the legalities of this, but it sees a reasonable approach to me
  • Ive still not had any reply from the landlord and yesterday we were visited by 2 more bailiffs. They had an Order To Remove notice and my wife needed to prove who she was to stop them coming in. They gave us a copy of the notice addressed to the Landlord. Can we use this to try and get out of our contract ?

    No, you can't.

    IIWY, I'd be spending a couple of quid on the Land Registry's website, and finding out whether there's a mortgage lender with a charge on the property. If the landlord's in that much debt, there's a very strong chance that he's not paying the mortgage either, and probably doesn't have consent to let. Since he used to live there, it's almost certain he doesn't have a BtL mortgage. Then write to the lender, enclosing a copy of your tenancy, to make them aware that the property is tenanted. The lender can still evict you and repossess the property, but they have to give you time.

    More importantly for you, since you want out, it may actually get them to set wheels in motion earlier, as well as preventing any real shocks from an attempted repossession on the assumption the borrower still lives there.
