Jointly owned property being sold - desperate for advice please...

    Yep the flat is next door to my aunts. It's a small block of 6, communal hallway and her door is next to his. Plus she really doesn't want him there as he's a nuisance, late night noise etc.

    The thing is if you did accept an offer from him going on his past behaviour there is a high likelihood that he would delay and delay with searches, queries, negotiations over trivia, demands to see the property. Anything that he can think of to cause you stress and inconvenience. Plus it would negatively impact on the future for your aunt and the residents association.

    I think the best thing is ignore any bids or requests for viewings. You have said there is a lot of interest and also we are coming up to spring which tends to be the busiest time of year. It sounds like you have a good EA, they can be your buffer.

    You need to get this property sold and move on, I do hope that the 'sole conduct' enables you to do this in the least stressful way for you.

    My concern would not be obstruction but given his previous behaviour he could:

    1. Wait until just before exchange then demand access and move back in.
    2. Wait until the day before exchange and demand more than 50%
    3. Delay and delay and then on the day of exchange decide he is no longer interest in buying the property; wasting the EA and the OP months of time and effort.

    The other small complication of transferrig to him is that the EA's fees have to come from somewhere and my bet is that he would not be adding the 50% to the money he transferred.

    As a joint owner i dont think this would be the case. The transfer and payment could be done tomorrow (unless a mortgage is required, which im not sure of ofcourse)

    Would the EA even get paid? they certainly cant claim to introduce him to the sale
