Can't believe 2nd accident in 10 days
As the title suggests, i have been involved in a 2nd car accident in 10 days. 1st time my car was vacant and parked in a legitimate parking spot when it was hit. Thankfully the driver left their details and has admitted liability. I am still awaiting repairs on the vehicle.
This recent accident, 3rd party was stationary, on the left hand side of the road, at a junction I was approaching. As I approached the junction to turn left onto the same road the car was on the car was still stationary. I exited from the junction and was then hit by the earlier stationary vehicle as it reversed into my back passenger door.
I indicated for the driver to pull over. Driver got out of the car and I asked for their details, they said I should have beeped as I should have seen her reversing. I asked her if she had looked before she started to reverse. She then stated I was at fault not her, I disputed this with her and said I needed her details. She was a bit sketchy but I am not sure she spoke very good English, so I asked her if she was insured and she said she didnt know and her husband wasnt there. I took her Reg number but that is all as she wasnt forthcoming.
Once home I reported it to my lease company, she has actually hit a side that was already scratched from the earlier incident and hit the door with sufficient force that the door is jammed shut.
The car involved is insured but have no name or address of the 3rd party. My lease company have said they will pursue her insurance company. Does anyone know what happens now seeing as she denied she was at fault?

Very dificult to make out what happened by the wording you have used. Try rewriting it to be clear.
It sounds like you were at a junction and started turning onto the road wile the tp was reversing on that road ? correct ?
If so I would think that at best you would be looking at 50-50 fault.0 -
You need to explain the second accident a little better, as I can't visualise how the other driver managed to collide with your rear (nearside of offside) door as you turned into the road. Have you used askmid.com to check that an isurance policy is in place for the other car?
EDIT - just noticed that the OP states the other car is insured."You were only supposed to blow the bl**dy doors off!!"0 -
So you turned into a side road and collided with a vehicle that was reversing into their driveway from the same side road?
How far from the junction were you at the point of collision?
What part of the TPV made contact with you?
She was the reversing party so the first attempt is to try and hold her liable for the accident but if that succeeds or not will depend on if you were established on the road or effectively are considered to still have been making your own manover of turning onto the road in which case a split liability decision is a likely outcome0 -
I suggest that you write up as full account as you can of the second accident, including sketches showing car positions, any markings denoting parking areas etc. Based on the info. That you've given it sounds like 50/50 but the details might change that. For example, was the other car parked in a legitimate parking position? Did it reverse out of such a position into the normal road area? Did it actually reverse into the road that you were exiting thereby crossing a dashed line at the junction?0

Sorry for not being clear. The other party was stationary (parked) on the road, alongside the pavement flush with the junction of the road I was turning into on double yellow lines. This was outside a shop and lots of people park on these double yellow lines rather than in the designated car park across the street. I was sat at the junction approximately 1 min as I waited for traffic to clear in both directions so that I could turn safely onto the road. Because she was stationary right at the edge of the junction I had to cross over into the other lane to pull clear of her vehicle so that I could make a left hand turn. She started reversing after I had left the junction and had almost made my turn hence how she managed to hit my rear passenger door.0

Yes Thierry. I was turning onto the road that she was stationary at. She definately wasn't moving as I left the junction.0 -
I asked her if she was insured and she said she didnt know

To hit your rear door most of your car must have been behind her. If she had looked she should have seen you.0
