  • Thanks ManxRed, Much appreciated!

I will draft something on that basis and see if there are any other comments tonight and then send across tomorrow to POPLA.

At least their response letter was easy to read and perfectly liable.

their operative on site failed to mitigate any losses by ensuring that the driver adhered to the rules of parking and so should have warned the driver that if anyone leaves the site they are in breach of the "rules"
  • Yey!!!

Just had the decision through from POPLA to allow my appeal on the basis that the operative couldn't prove that i had left the premises.

I will post the details in the appropriate decisions sticky.

Thank all of you so much. Who know what would have happened if I hadn't caught your help and you all weren't kind enough to give up your time to help me!

well done m8, gives me a great sense of satisfaction to know that JAS were beaten yet again from my help and others on here

they tried the same sc@m on a friend of mine for B & M stockport and lost that one at popla too, with help and advice I read on here

this is one reason I like to make them lose each and every time, the more money they lose at popla the better , revenge is a dish best served cold , so JAS are losing every time they (and others) try these sc@ms on shoppers

Peel Centre (Excel) was another one I helped on until it went to the IPC for similar reasons , if you sc@m me or my family of friends you get it back 100 fold , and with popla that means no gain at all plus a loss of £30 plus all the time spent on bringing their case to popla, postage costs etc
