debt recovery ltd, court letter thing

have been told to start a new thread for this,
i have tried to work out the other threads but i have an illness that affects my memory and concentration so i find it difficult to work out what is meant when there is so much informaiton, so....

im really confused about these parking notices, so forgive me but if i outline what has happened could someone point me in the right direction in the simpliest terms ...

the RK (and driver) no longer lives at this address but has been in touch and has given me permission to open their letters. apparently they received a parking ticket from minsterbaywatch Ltd on 27/8/2014,
this was a train station car park and the machines were not working, the driver does not have a mobile phone so could not ring the providers.
when they returned they had a parking ticket which was lost whilst moving away. they have now got a letter from Debt recovery plus Ltd saying reduced payment offer to avoid court proceeding ...

they have also done the rk details from DVLA, however the car was scrapped, well supposedly, as DVLA have written to say the new "registered keeper" needs the paperwork signing to transfere ownership (december 2014), DVLA have had this informaiton and lost it, this has now been rectified.

so what does this person do now? they have moved from york to london, i only have skype contact with them. what do i do if the balifs turn up???

    Show them some ID and they will leave.
    If they can not be bothered to update address details put the letters in the bin and rid yourself of their problems.
    Debts, CCJ's and even warrants of execution for bailiffs are all in a name only.
    If thats not you, there is no issue.

    First of all, Debt Recovery Plus, and any other debt collector for that matter can be ignored. They are toothless, have no powers, and cannot take anyone to court. All they can do is send free bog paper. That is literally all these debt collector letters are, bog paper. Never ever ever contact a debt collector as it will just prolong the receipt of bog paper whereas if they are ignored they will eventually give up.

    One suggestion would be for the RK to contact Minsterbaywatch and tell them the name and address of the driver. The driver will then get a new PCN in their own right and this can then be appealed using the template letter in the NEWBIES thread.

    Alternatively the RK couyld ignore everything and hope Minsterbaywatch never find out their new address for six years starting from the date of the event.

    Hopefully one of the experts will be along soon with better advice, but the most important thing is, don't panic. This isn't going to cost you or the RK or driver a single penny.

    thankyou, again apologies for looking thick, ive got someone to read your replies for me and i will sit tight and if the balifs turn up i shall, maybe offer them ID.,.. what if the RK does get a court summons?

    None of the above is likely to happen. So please relax. Minster Baywatch have never done court and I don't think they're about to start any time soon.

    Court 'summonses' are related only to criminal cases, which a private parking ticket is not one of!

    Debt collectors can threaten whatever they like (including skinning your cat alive), but they are totally powerless to do any of it.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
