Ombudsman rejects AR removal request

Hi guys,

I have an AR marker from Barclaycard showing on my credit reports, which will be there until 2018 (10 years in total). I went through the process of asking Barclaycard to change this to a default account so that it will drop off my report(s) sooner (unfairness / old ICO Guidelines), but they wouldn't budge. I then complained to the ombudsman, who initially sided with Barclaycard, I then asked for it to be looked at by an actual ombudsman, who have now rejected my complaint also.

In the letter I have received, they state, if I accept the ruling, to sign a form and send it back, and if I don't, just ignore the letter, or write to them saying that I reject their ruling. I have absolutely no intention of accepting the ruling by the way.

If I were to write to them saying 'I don't accept your ruling', does anybody know what, if any, their response would be? - i.e is there an appeal process or anything? (it really isn't clear in the letter).

Also, now that they have rejected my complaint, I am guessing 'that is it', and the marker will remain until 2018 - or would anybody happen to know of anything further that can be tried?

    If you reject it does it not go to the adjudicator to review?


    Someone in the know will probably provide a better answer.

    The FOS unfortunately often delude themselves about this, that somehow its better or fairer to have an AR showing for 10-15 years than a default for 6.

    Apparently a creditor will see the AR as you acting more responsibly as compared to a case where the defaulted account no longer appears at all on your report. :huh:

    Complete bogus logic.

    How an adverse marker could look better to nothing at all is madness.

    Afraid in life theres no accounting for idiots, and inevitably some are employed in the FOS.

    Not sure - It has been rejected by me twice - once was the initial person that looked at it (not an ombudsman - which I rejected), and then it went to an actual ombudsman - who has now just come back and sided with the adjudicator / Barclaycard.

    There is nothing in the letter though stating what will happen if I do reject it (for the second time)

    Try asking on legalbeagles.info Think you may have come to the end of the road as far as the FOS are concerned but may be some other legal avenue. People like this http://www.theguardian.com/money/2014/jan/28/laptop-credit-agreement-fight-supreme-court post there who have fought ironically from the reverse persopctive.

    Snap my has been rejected by the ombudsman service to day as well told to except this decision as it is the end of the road still wrote back saying rejecting it can i ask for it to removed six years after last payment or will I have to wait to 2025 the full term and 6 years then try and get it removed

    Barclaycard are w*****s Im in the same position started dmp in 2009 8 creditors all defaulted in sept 2009 apart from barclaycard,with ar on file.just about to complain to obusnsman but sounds like no point.

    Remember getting a letter of barclaycard saying they sold the debt to a debt management company, but it was just a different department and I remember they got fined by the fsa for trying to trick customers.
    If it's sold it has to be defaulted so trying to find that letter.
    Just thinking of another route we could try
