  • I did ask for help but at the time it was near christmas my daughter was in hosp and I just hadn't got the time to read lots and lots of info, I felt like I was going round in circles so just ended up paying the £40

    every thread i read it seemed that I was going to lose at POPLA so just paid, I didn't want to but at the same time I didn't want to end up paying even more out than £40

    Napier's NtD and NtK do not, IMHO, comply with the requirements of Schedule 4.

    I know this because my car happened to park itself in a Napier car park recently, (while I was in the office, of course) and the paperwork I have seen is ludicrous.

    Parkingeye v Cargius (Snowdon Mountain Railway ) would be an useful read if there has been a failure to pay. Of course if the ticket was valid and had simply "slipped" then there is no loss

    I tried that in the 'Mrs RS' appeal (the one with the legal invoice itself) and POPLA said it was OK and despite protests, even pointing out the POPLA fee was in the GPEOL, she lost and paid. Hope you win the one you are working on, BM but it was odd, almost as if POPLA were over-impressed by Mr De S and his QC.

    Thanks for all your input everybody. I think I'll put in a POPLA appeal and then take it from there depending on the outcome, probably taking the given advice of paying to avoid any court proceedings, if it comes to that.

    Edit: There was no pay and display ticket purchased.

    You will need a very strong POPLA appeal, not a generic one, also Napier read this forum!

  • hahaha yes, just commented on the one, found the FB page now too, I've had to have a chuckle at some of the comments, and can't believe that one poor person got a parking ticket after 8 seconds!!! That's unbelievable, wonder what happened with that one?
  • i have just received one for 10 seconds!! is that legal? i have been trawling to find out if anyone else got a napier one for such a short time. it takes me longer than ten seconds to get a ticket when there is a queue on a busy lunch time. i received one through the post. any ideas?
