There is a big clue in the opening post. The op received a 'copy of a CCJ letter', nowhere did he state 'notice of intended prosecution'.
Now, inmy experience of dealing with HMCS, all the official paperwork they send-out when reffering to claim has the Court seal and case number on it.
The fact that the op received a copy of a ccj letter rather than a proper notice of the claaimant's case, sounds a bit suss to me. The Court would have sent out a Court-stamped form laying-out the claimant's case and asking if you wished to defend the claim. This would have also have the claim number on.
As for 'overstaying' due to the car breaking-down. That is irrelevant. The main fact is that the car park is FREE. So no losses incurred by the operator whatsoever.
Op, fill out the N244 but do not mention the fact that your car had brocken-down. That is not relevant.
When you do get your day in Court to have the CCJ over-turned, you can then claim your costs off CEL/The landowner.Never Knowingly Understood.

Hang on Patman, just why do you think that the fact that the car broke down is irrelevant, it is not a mitigating circumstance, but the cause of the overstay.
AFAIAA, all Local Authorities and the police will cancel a ticket in such circumstances, and I have read of two Judges finding for the appellant when the car broke down. What happens when you have to repair a puncture?You never know how far you can go until you go too far.0
