I heard my tenant was looking to rent another house .They have said the house is to small and they want /need a four bed house .They didnt tell me they have been looking but they have told other people .
Two adults and 3 children in a three bed semi .
To be truthfull they have been a pain in the @rse from day one so i wouldnt miss them.

They have now sent me a text asking me to serve notice so they can get council accommodation .:rotfl:

one the one hand I think great I could get them out ,on the other hand I think fook you .

They are renting this house from August 2013 ,but they have been on the council waiting list for 6 years.

I haven't replied as yet .

    It might not end up being a case of just issuing a Section 21 though. If the council decide to gatehold them (which they're not supposed to do but many seem to) you'll end up having to go all the way to court and possibly bailiffs too. Then try and recover the cost from the tenants. Is it worth the hassle?

    I suppose you could always issue a Section 21 and hope that's enough and then not act upon it.

    It's a tricky one because on one hand it would be nice to see the back of them but on the other it could involve a lot of hassle for you.
  • Evict using s8 for breech on tenancy & they should not be rehoused. Any rent owing ever?

    Alternatively you could write to council housing department - after getting tenant to put their request to you in writing - explaining you have been asked by tenant to make them homeless & would that make them intentionally homeless.

    Nasty game, lettings.

    Why should PIAs be rehoused at taxpayer expense?

    Has there been a breach of tenancy? The OP mentions them being a pain but has not been specific.

    Given the shortage of council accommodation they would probably end up in a B&B or a hostel. There was a very sad thread recently about a family with two disabled children that had been on the waiting list for I think 14 years.

    With three children I would think they would only qualify for a 3 bed as two of the boys/girls (whichever it is) could share. The tenants may contact their local authority and get a reality check and change their minds.

    This request for a S21 aside would you have probably issued a S21 anyway in the next 12 months or so as they are such a pain? If so you may as well do it now, at their request, and get it over with. Out of interest in what way are they a pain?
    It is a good idea to be alone in a garden at dawn or dark so that all its shy presences may haunt you and possess you in a reverie of suspended thought.

    A pain in what way?

    Is the rent regular? Up to date?

    Are you having to do regular/expesive repairs? If so, are the repairs justified? Tenant fault?

    How quickly/easily could you replace them? How long might your void be? Would you need to spend money updating the property before re-letting?

    A bird in the hand, even a wounded bird, is often better than two healthy ones in the bush (forgive the metaphor...)

    There will be a breech, if only (say..) not keeping the place & garden tidy or one of the other daft standard clauses in almost all tenancies: Or rent late or in arrears. My point was however, don't play into any old scr*ats hands & get them rehoused at taxpayers expense: There are higher priority, more deserving cases.
