Holiday Insurance Claim

I had holiday insurance with Virgin, and travelled with Thomson airlines. Our bags were delayed for 3 days, so essential items were purchased which Virgin are covering. When our bags arrived they had been broken into and items stolen, including Christmas presents, toiletries, dress jewellery, Ipad mini and Kindle. I can only claim for items which I have receipts and proof of payment. Thomson are replacing my damaged case. Virgin will not pay for any valuable items, so I approached Thomson. They have offered compensation for non-electronic items, ie the Ipad cover the Kindle cover, toiletries and a watch, but won't cover the electronics. In my mind if they are offering to pay for items, they are accepting liability. Do I hold out and not accept their initial offer, and try for compensation for all items stolen or just accept what they are giving me?

Can I ask why you didn't take your electronics/valuables as hand luggage?
  • I tried to fit everything into one case but went over the 20kg limit so took out heaviest items and put those into hand luggage. Live and learn eh??

Most airlines have a disclaimer for valuables in hold luggage

    8.3 ITEMS UNACCEPTABLE AS BAGGAGE
8.3.3 You must not include in Checked Baggage money, jewelry, precious metals, computers, personal electronic devices, negotiable papers, securities or other valuables, business documents, passports and other identification documents or samples or necessary medication.

their argument is that these items should not have been in the hold baggage. Is the reason the insurance will not pay out the fact that the items were in the hold baggage?
  • Payment will almost certainly be marked as a guesture of goodwill which means there is no admission of liability with it.

Given you breached airline rules in putting the electronics in the hold you have probably gotten as good as you'll get
