Car Shop

I recently bought a BMW from Car Shop, the Salesman told me it was 1 Owner, Full Service History, when I got the keys it turned out the vehicle had missing Service History, over 40k with no records, they assured me they would find out and let me know the day after and take it from there.


They offered £150 for the inconvenience, taking 3 hrs to pick up car, I thought OK.


They have finally confirmed 2 days later that there is no details for the missing history, so basically tough.


I've been emailing and phoning them over the last 6 days, they now want £765 for the 200 miles I've done in the car and charges for cancelling the finance even though its been less than 7 days.


What are my rights? They've been lying to me and have no intention of making things right...

    Depends on the age and price paid really. usually i wont touch it if the service history is not all there and better than the manufacturers recommended intervals.

    But if it was cheap enough and everything else seemed good i may take a chance.

    Do you still have the advert stating FSH?

    7 days meaningless. Its not something you bought without inspecting it and had posted.

    If your unhappy then return the car, If they wont refund your money start a small claims action against them.

    Have you got legal advice on your home insurance? They can be helpful in cases like this.

    You need to look at The Consumer Protection from Unfair Trading Regulations 2008. This is what stopped dealers selling cars without declaring they were write offs.

    3.—(1) Unfair commercial practices are prohibited.

    ...
    (3) A commercial practice is unfair if—

    (a)it contravenes the requirements of professional diligence; and

    (b)it materially distorts or is likely to materially distort the economic behaviour of the average consumer with regard to the product.

    ie. if the average consumer would be likely to offer less if they had known the service history was missing, then the seller has committed an offence.

    I'd also phone trading standards and lodge a complaint with them.

    Hope you get all your money back.

    I believe they are entitle to make a deduction, but it has to be fair.

    I'd have said about 20p a mile would be appropriate, but I'm not a lawyer

    If its a late BMW, the service history may be available via the key. Take it to a BMW main dealer and they may be able to help you.

    My dad had the same problem with a car from there where they had no history, but we did a bit of research and worked out the part of the country where the car was first registered.

    Then phoned a couple of the dealers in that area until one of them said yes we have that car on record, and the posted us the full service records, and stamped the service book as well.
