Fighting PCM Parking Charge, been contacted by DRP.

Hi there,

I'm fighting a parking charge from the lovely people at PCM Ltd. The PCN was issued way back on 11th of December 2014, as the "shiny" part of my parking permit was tucked under my dashboard with a little of it still showing. I had been parking this way for a month and then received the PCN.

I swiftly appealed, and when doing so made an error on the address that I gave as I hadn't been staying at the property for long (I'm a student). The car in question is therefore registered at my actual home address which is an hours drive away. As far as I'm aware I haven't received an NTK at that address (does this invalidate everything?). I still have until the 15th of February to receive it.

Today I received a letter from DRP with the usual scary words (it is actually getting quite fun now) and they are asking for £160, instead of £100 which is what PCM told me I would have to pay if I didn't pay within 14 or 28 days, can't remember which.

After reading the [STRIKE]mammoth[/STRIKE] NEWBIES stickied thread with the steps, I have been lead to believe to ignore DRP. However I think my case is special as I haven't (as far as I'm aware, my father is looking for it when he gets home) received an NTK, which means surely it's all irrelevant anyway and they have no business bothering me.

As I mentioned previously I made an error with the address, which is the same error that DRP have addressed to, so I can only assume the DVLA has not been involved and PCM have simply passed on my erroneous details to DRP.

Thinking that this is probably a huge ignore job, and I should retain any correspondence just in case?

    Read the NEWBIES sticky thread, again. Then read it again and focus on the DC section (post #4 I think). :)

    If you replied to the windscreen ticket, you will very likely not not get a NtK

    Thanks, I did go back and a second read made more sense of it. I think the information might need to be collated a little more efficiently.

    Could you explain why that is? And surely this means I am not liable to pay a penny. It's laughable that they are using the mistake I made in the address and even more so that they are assuming it's the address at which the car is registered. This area is full of university students.

    If they get no reply to that within a certain period of time, they apply to DVLA for the RK details, then send a notice to keeper.
    They won't bother with that though, if they have already hooked someone with the Notice to Driver

    Ah, so by biting the PCN I've hindered myself there?
  • Also, is it worth appealing to the IAS at this point just to get rejected?

    This kangaroo court business seems like it is hassle to deal with.

    After further reading it is recommended that I post NtD and DRP correspondence...should I be preparing to take this to court?

    if you had a rejection then you have 21 days from that rejection to appeal to the IAS (which is usually a waste of time) - after 21 days has elapsed they wont accept the appeal

    you can ignore DRP, they are powerless

    PCM or the landowner have 6 years in england and wales to take it to court

    Thanks for that info Redx. I acquired a word document that HM Gov. had written and it listed the amount of court cases a company had, it was however only for companies listed with the BPA. PCM UK only had 2 cases, not sure how many with IPC though, so going to take a chance with that I think.
