private company ticket for using a disabled bay

Hi there,

Before Christmas I was visiting a cinema to treat my daughter and we spent 30 minutes stuck in very busy car park trying to find a free space without any luck. With the time of the film fast approaching and my patience running out, I noticed that there were about a dozen available disabled bays at back of the cinema far away from the main entrance - and in addition to the disabled bays at the front of the cinema. So we parked there as I thought there was plenty of spaces left for genuine disabled users, and it seemed odd that the spaces were not near the cinema entrance.

When we got back to the car after the watching the film, there was a ticket on the windscreen. Last week, the NTK was sent to my partner.

I originally asked Parking Ticket Appeals Service Ltd to help me but they went silent and then ceased trading.

4 days ago I asked Private Parking Appeals to draft me an appeal, but I haven't heard anything back yet.

Neither myself or my daughter is disabled, so my question to the board is: If we appeal do we have a decent chance, or should we just pay £100? (I'm quite busy with work and family and could do without the hassle of appeals etc, and I can afford the fee - but I really don't want to be financially supporting companies who trade on fear etc).

    Firstly no one on here will condone the use of a disabled bay when you don't need one. There is a reason there are disabled bays and that's because companies must supply them by law to conform with the Equality Act 10 and it's just selfish to use one when you don't require it for a genuine reason.

    That said, there is no need to pay anyone to appeal for you. If you can read understand basic English, then it all the work is done for you in the newbies thread. You just have to read that and amend it to your circumstances.

    That's all very well blah blah blah, but the fault lies either with disabled people for not getting off their @rses and using them, or there are too many disabled bays, or, more likely, Local Authorities are refusing BBs to too many genuinely disabled people.
    You never know how far you can go until you go too far.

    Well you won't be complaining now that you have your blue badge, you should have no problems getting a space, but what you have said doesn't help the OP in anyway, maybe you should lobby your MP, to change the law or stand as a MP yourself, seeing as you have such a bee in your bonnet about.

    I am not disabled, have no problem parking a further 50 yards away from the front door, if it allows a disabled person easier access. If there are no 'normal' spaces available, then maybe the car park is not fit for purpose, maybe you should concentrate you anger on getting the car park made bigger, rather than the disabled.

    If parking was free then there was no initial loss. If there was no initial loss then there can be no consequential loss flowing from the alleged breach of terms of parking, thus there can be no Genuine Pre-Estimate of Loss. ;)
