Athena parking notice lidl

Hi,

I have read through the newbies guide before posting and have a worry that I've already identified myself as the driver in an online appeal form. I was issued the notice on 21/01/2014. I have read on many links saying ignore ignore but this forum has shown me not to ignore and me appealing on 23/01/14 via their online form was in anger and annoyance. I posted:

Hi,

I am appealing this decision based on recent events within the Carshalton/Wallington area
which have prompted me to be worried for my partners safety.


There have been some recent police incidents in the area namely:
a woman attacked on our road (link to report) & a school girl being raped in a nearby park (link to met police report).

As you can tell I was only in the car park 10 minutes longer than the apparent 10 minute limit for non-lidl customers.
The signs don't state any sort of time limit but more importantly I was only parked to pickup my partner
whom was on the Southern train from victoria to wallington (train ref: train confirmation link).

I hope if you read this, you understand that I was not looking to take advantage of your property
- I was simply looking out for the safety of my partner and felt I should at least contact you, to mention this.

I sincerely hope you void this fine based on these facts and I will look to be more aware of the limitations on the car park.

I wish I had read up before but I'm worried that this appeal identifies me as the drive and creates a problem for me. What should I do next? I haven't recieved the POPLA code or a response to this but I was wondering if I could simple send another appeal using the template you've provided.

  • All is not lost.

    According to the BPA website Athena ANPR Ltd are members so if this is the PPC then they should send a POPLA code with the inevitable rejection to your appeal.

    While you are waiting for this check out the how to win at POPLA in the Newbies sticky.

    Forget mitigating circumstances (however valid and concerning they may be).

    Follow the advice of the regulars who I'm sure will be along to help

    Am I not able to send more than one appeal to Athena using the template?

    I was thinking of posting an appeal as well (not recorded) using the template to see if they reject. I'm also going to the store tomorrow to complain, I've had Lidl's official twitter account ask me for the outcome of my appeal and I'm just wanting to squash this asap.

    Patience I expect is a virtue in these circumstances.
  • I think you only get one shot at the PPC.

    I would wait for the POPLA code then shoot them down with that silver bullet, plus its costs them 27 quid + VAT for your appeal to POPLA

    No.

    Just appeal on the basis that the charge doesn't reflect a genuine pre-estimate of loss, and that Athena don't have sufficient landholder rights to offer parking and you will be OK.

    Right well I have an update to post..

    It got cancelled. They sent a letter that came today. Just said it was cancelled - no reason for why. Only interesting thing about the letter was that it said 'dear lidl customer' which I wasn't. I did however bang on at lidl's uk twitter account and got a 'please let us know how your appeal goes' tweet. There was no POPLA process required.

    So all in all a success!

    See I'm assuming that but I never gave lidl my last name, or reference number. All they would've got is '20mins', the car park & my first name.

    Either way. I did go to town on their new hashtag '#lidlsurprises' maybe that got their attention.
