Smart Parking ( Asda )

Hi all,
Received a parking charge for overstaying in my local Asda car park.
To cut a long story short, I went in twice that day at different times and the camera has got me arriving the first time and leaving the second time, making it look I was there ages.
I actually visited another Asda ( I know, three times in total in one day ) during the time I was alleged to be the said one and have the receipt for that visit.
Is it just a case of telling them to look at the CCTV/ANPR footage again, which will obviously show me leaving and not breaking the T&C's or do I need to word it in a particular way ?

This is called double dipping and is a common fault with private parking where ANPR cameras are used because they are not fit for purpose. This should be an additional point in your multi-point appeal to the parking company.

I've read the newbies sticky, I'm I right in thinking that I am arguing the legitimacy of them issuing the charge ?
Like I said I went in twice that day, is it not easier to explain that and ask them to check their CCTV footage again ??

yes you are querying the legitimacy of their invoice
send the template letter, add a point that THE VEHICLE made 2 visits that day which will be one of the points made in any appeal or court case ( dont reveal who was driving so no words like "me, myself or I" ) - so tell them to check their ANPR cameras for BOTH visits and then to cancel the invoice
You need to learn to talk in the third party, so not I did this, I did that etc0 -
x) The vehicle visited the noted site twice that day - your ANPR system has simply captured the first entry and last exit times, and missed the intervening exit and entry. Indeed the vehicle visited a different ASDA store during the time you allege it was parked at the noted site; a receipt for purchases is available to prove this, and a copy of said receipt is attached with this appeal. Accordingly your claim has no foundation and you must cancel the PCN.0

Well I went in Asda yesterday for a firm chat about this fiasco. They told me to leave it with them to deal with.
Thought I'd send the appeal to Smart anyway just to be on the safe side, but the Smart website says its been cancelled and no appeal is necessary.
Hopefully that's that then, thanks to the people who advised.0 -
This happened to me last year. I went back to the carpark to take photos of the signs and the parking attendant tried to detain me, telling me to stay put while he called security!!!
To cut a long story short, I'd ignored all the letters from SMART (about 10 in total) and they eventually gave up. I didn't bother using the so called independent appeal service. It's funded by the industry so how can it be independent?
I waited for my day in court but it never came.

I would be back into Asda to thank them, but ask as to why you should continue to shop there with them .... shoppers do not need all this aggravation. Its my guess that others will have been caught the same way -these cameras make this type error all the time- and sadly paid up :-(
Ystrad Lad glad your case was sorted .... but your advice is not correct , things have changed people should now always appeal!

As already mentioned, the advice for over two years now has been DO NOT IGNORE. You were lucky you got away with it but many PPCs will take you to court if you ignore. It is much easier to make the initial appeal and win than it is to win in court.I married my cousin.
