Old CCJ advice

So i found out this week that i had a CCJ issued against my name in august 2009 for non payment of rates. This was at a time when i sold my property and moved to another part of the country. This turned up on my experian credit report, even though i have used experian for years!

I have very detailed records from the sale, where my responsibility for the annual rates was passed to the purchaser with a pro rata allowance from me to them to pay for the period i was there that financial year (24 days).

Effectively 2 legal documents confirm the sale with provision for the rates tied into it. Very standard and all above board. The person moving in hasn't bothered to pay them or inform the council they moved in and I was issued the CCJ, to the address they were living in.

My question is..... As this is now 5.5 years old, is it worth my effort getting this set aside? At my expense i can pay to have this done, or i can just ignore it as it will be wiped off my file in 6 months. I have already spoken to the council of the situation and they were very helpful, but said it was my problem to set aside the CCJ, even though i could legally prove i didnt own the property.

Alternatively, i can pay to set it aside and risk dragging the whole thing back up into the system and staying longer on my record.

Morally i have no obligation to this debt at all, it is only for £270. I just want the easy life....though feel the person who bought my flat should pay in some way.

    I have a similar problem with a default from British Gas for the person that was in my property before I moved in and I found the debt was then put in my name. Not my debt and I have no obligation to pay it but it shows up on my credit file. I only discovered it last year when I applied for my credit files. It will disappear in about six months as well.

    I find it strange this has just shown up on your file. But if the debt hasn't been sold on to a collection agency and the council have no intention of chasing you for it, then I suppose it depends on if you intend to apply for credit within the next few months before it drops off your file.

    If you don't intend to apply for any credit or a mortgage etc. then it may well be worth leaving alone if you can't bear the thought of the expense and all the hassle of getting it set aside.
  • Its clearly been visable to banks etc for years, as i had a great credit score, money in the bank and no debts what so ever, could never work out why i couldnt get a credit card.....even with my own bank where i have 20 k saved up.

    it all slots into place now. i am not happy, but willprobably just let is slip off in august.
  • You sometimes see questions about ever having CCJs on applications. If you get it set aside, I guess you can safely answer no to that question.
