Parking PCN - No grace Period!?

Hi people,

I received a PCN today while stopping to collect mail from the post office. Since I had no coins with me, I went to a local shop to get some change and when back (2min) I found an inspector just stopped from a motorbike and fined me within my presence.

Apparently he told me that as the fine is started, on his handheld, it can no longer be cancelled, so this was the detail on the PCN:

Observation from xx/xx/2015 at 10:25 to xx/xx/2015 at 10:26.

I think this is a bit harsh as there was no grace period being applied.

Any advice?

    What inspector?

    If council traffic warden, you need to head to pepipoo:

    If not, replace word 'fined' with 'attempted to scam'. Private Parking Scumpanies cannot 'fine' anyone.

    Yes, it was from the council
    I don't know if a traffic warden. Just a man on a motorcycle with a handheld device.

    I think ampersand means have a read through some of the posts on Pepipoo before you post to give you a 'feel' for the type of information regulars require from you.

    When they're really busy and not all information has been provided, newbie threads can very quickly slide down the forum and get far less attention (or totally missed) as a result.

    The mistake you made was not going to the machine, jamming some coins in and hitting the ticket button.
    It takes them about a minute to print a ticket out, they love it when you run over to remonstrate, they have all the time in the world then.

    If you are going to challenge this based on any grace period, you will need to look-up the current policy/guidance docs for the council concerned as strictly, grace periods are not required by the current legislation, so patrollers can ticket on-sight unless their authority has set a grace period - which many have but some have not.

    There are however plenty other things the council have to get right before the ticket will stand-up, so all is far from lost for you! :)

    Pepipoo is the best place to guide you through this but it will help you a lot if you read the FAQs/intros and provide all the info they ask for in the correct form from the start. They are at least as busy as this Forum for helping people so don't have a lot of time to carry those who won't do at least the basics to help themselves.

    The adjudicates do allow "grace period" .. IF you have a ticket from the machine.
    Otherwise, they usually boot that excuse in touch.

    Say the warden is trying to fill his quita to avoid a rollicking and you are stood at the machine, you have a good excuse if your time in your ticket pre-times his or is very close.

    I haven't managed to get much help on pepipoo. Basically they mentioned that without ticket there is no grace period. I honestly have done this a few times when I don't have any change with me and never really thought much about it.

    To my own defense, London is covered by CCTV (and there are clear warnings), therefore I am aware I could be fined without any physical inspector showing up, and for that purpose I always retain parking tickets a few months, just in case. But having a guy on a bike stopping and issuing a fine right in front of you is a slap on one's face!

    Much to my disappointment, I was so gutted with the guy I completely forgot to take the ticket afterwords. I'm sure with the ticket I had a case as they need to allow time for one to purchase it and the marked time, with the PCN time would be self explanatory. One more as experience.

    pogofish, thanks for your advice. I will call the council or check their web page for any grace period regulations. Apparently they allow the same discount if an appeal is not granted, so I cant really loose in trying to appeal.
