The question I would ask first is why you believe the defaults shouldn't be on your file? You do no elaborate on this.
Did you or did you not default on the accounts? If you defaulted then paid the accounts the default will still stand as it is a true reflection on how the account was run.0 -
The landlords house I was living in at the time asked me to leave with immediate effect. It got a bit messy and I could not re-enter to give British gas the meter readings which they say they needed. I refused to pay British gas because they wouldn't cancel the bills until I gave them the meter readings and I would have been paying for utilities for a landlord that essentially 'kicked me out'. (Legal action was taking with regards to this, but the British gas problem was not resolved) I have been down the route of explaining all this to British gas, to no avail. So I'm trying a different angle.0

Gas is not a Consumer Credit account, so (1) does not apply.
(2) does not apply whatsoever. Even on a CCA regulated debt.

I don't think people are trolling you. You have had a number of valid questions asked. Deleting your original post isn't helping you is it really?

Customer Reference Number: XXXXXXXXXXX
After recently obtaining a copy of my credit file from Experian I was concerned to note that your company has placed a 2 default notices against my name, for Gas and Electricity utilities.
Further to this, I have no recollection of ever receiving such a notice, and I therefore require you to substantiate this data at your earliest convenience.
1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit). Your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number 1587 716732.
2. You must supply me with a signed true and certified copy of the original default notice
3. Any deed of assignment if the debt was sold on
I would request that this data is provided to myself within the next 28 days, if you are unable to provide this data then I must insist that it is removed from my files as unsubstantiated.

So, hopefully I'll get reply quite soon, and will keep this thread updated. These 2 defaults are stopping me getting a mortgage which I desperately want to get this/next year. If British Gas come back to me with the default notices, then I'll have to bite the bullet and wait until 2018 when they drop off, but I'll happily fight it until then to get them removed sooner.
I advise anyone reading this to stick with this forum, the advice on here has been excellent and has really got m motivated to get myself sorted over the years.:beer:
