Any successful stories about getting compensation for deposit not protected?

I think I will take my previous LL to court over the non protection of my deposit (I moved out in 2011). Recently I was checking again the emails I have sent to them and had from them during the tenancy period and I remember now all the hassle of begging for simple repairs and not getting it, all the broken promises, all the unhelpfulness and all the ridiculous deduction they made on our deposit when we left.
My exH's dad have a painter and decorator business and they did the whole place up and we still got charged (robbed) for stupid stuff (e.g.: when we let the property there were old blue carpets, but on the moving in date there brand new cream carpets, after 3 years, they charged us for wear and tear on the carpet even though we cleaned it professionally before moving out)…
Anyway I was very naive and juts wanted to move out, never knew tenants had so many rights.
Anyway, I have never received any P.I regarding the deposit and a quick search didn't show up that the deposit was protected at any point.
I have printed a letter from Shelter to send to them advising of my wish to claim my composition and I want to send it tomorrow.
I am also in two minds if I should use a no win no fee company or not? How much percentage they charge? Would it be simple to just do it myself?
Any successful stories?
Ah, the reason why it all came to the surface again is because I see their advertisement to rent the flat and the pictures where all of when I was living there…all my furniture and personal belongings in all of the rooms! I am not even sure when they took those pictures as I never sent anything to them…It must have been when they were showing around to prospect tenants after we gave notice…I laughed at first but now I am fuming TBH.

Well I used a template letter from Shelter website and sent it to the agency today (I don't have the LL's address).
The letter give them 15 days to pay me the 3x deposit or I will proceed with court action.
Lets see.
I would be really interested in hearing successful stories on this matter.
Thanks.0 -

btw yes a tenant can sue either/or/both landlord & agent. IMHO he would be wiser to sue landlord.0 -

There was an article on Landlord Law Blog about this very topic. It's written by a TRO based in London. You might find it interesting.0
