  • Yeah I can imagine it must be hard to remember everything commented on...having just been on here over the last week or so I can see its never ending...you guys are doing a great job and whether my appeal gets allowed or declined I appreciate all the help you have given.

    The Notice to Keeper requirements of the protection of freedoms act are not met. As keeper, I am therefore not liable.

    You are correct in that they should have sent you an NTK. They have 56 days from the date of the parking event. I would delay filing your POPLA appeal until day 57, unless that takes you outside the POPLA appeal time window.

    If you already submitted your appeal, just email in the extra point

    No you have misunderstood I think - they did still have to send a NTK as long as the driver was NOT identified - sounds like your appeal was worded spot on and they fell into the usual trap of forgetting to then serve a NTK because you had appealed and they assumed you were driving (they can't assume that, POPLA won't have that). Add the wording hoohoo has suggested even if you email it to POPLA or add it on the page for 'additional evidence' which you are allowed to add.

    Hi all...just quick update to say thank you all for your help - been much much appreciated - just to say I won at POPLA...didnt include about the NTK as had already sent the paperwork and didnt check back here after I sent it!! But UKPC didn't even submit any evidence so won be default it appears. Will post to successful appeals thread!! Thanks again to a great service and forum!!
