UKPS and Southport hospital

My son was using his mother's car and took his friend to A&E at the above hospital.
On entering the car park all normal spaces were full so he rashly parked in a disabled one. He got a ticket claiming £100 reduced to £60 on prompt payment.
I have become involved as they are now threatening small claims court having received a letter from a legal threatening such action.
I assume they've ignored previous correspondence hence that's why it's come to this.
His mum and myself are divorced so I'm not 100% up to speed with the details. I believe he should pay something as he parked wrongly but not the £160 now being demanded.
He was more concerned about getting attention for his friend than where he was parking.
Any advice greatly appreciated.

the RK needs to send a letter to UKPC naming the driver and absolving themselves under POFA2012
then the driver can appeal this in their own name

How serious are these people about pursuing court action and will they settle for a payment that isn't extortionate?

UKPC have never done court. They filed a few claims in Scotland recently but pulled out when they realised they were going to get a gubbing.

In England/Wales ... they've been to court twice I believe. Both times it was someone else taking THEM to court (and winning).
That doesn't mean they'll never do court, just that it's unlikely.
And DO NOT offer any form of payment at all. If you do they'll think they have a sucker and will just increase the hounding.0 -
1. How serious about court? Try and find them on this list of PPCs who've 'done court' in the latest available 18-month data.

2. Will they settle for less? :rotfl: NO! They would really like more!
3. CCJ? You clearly don't understand this stuff.
To get a CCJ potentially affecting credit rating, you need to go to court, you need to lose, you need to have costs awarded against you, you fail, refuse or forget to pay in the stipulated time ......... Which takes you right back to 1 (above) again.
You need to kill this off via your initial appeal, or if that fails, at POPLA. All in the NEWBIES FAQ sticky.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

although its unlikely , any of these companies could try a court case in the uk, doesnt mean they will win, but they , you , me , anybody can do so and try
if they win and your son doesnt pay within 28 days (in england and wales) they can get a CCJ
so its not paying the court after losing that actions a CCJ , if he lost and paid up promptly it still wouldnt happen
but as above, cant see UKPC (or UKPS for that matter
) taking one to court , they usually leave it to the big boys and in any case the PE vs Beavis case next month may change matters somewhat anyway
concentrate on what is in front of you, not what may happen in 2 years time, or never , why worry about what may never happen ? kill it by following the advice already given , and read up on these matters if you really need the full chapter and verse
