NTK from Norfolk Parking Enforcement

In todays post I received a NTK from Norfolk Parking Enforcement Ltd, for an apparent parking offence on Saturday Evening - received less than a week since the offence.

No ticket was given at the time.

The letter shows a picture of the car which I am registered keeper of, together with a link to a website where I could view the image, plus an invitation to pay £ 60 now or £ 100 later.

Looking at the online, as an amateur photographer I knew to look at the EXIF data embedded into digital photographs and I could see that in this case the camera used was a cheap Samsung compact camera, and the visible date stamp would be simply whatever the operator sets the camera clock to be. I repeat, no ticket was issued at the time.

Naturally I have no intention of paying and will be taking steps to issue the preliminary appeal first, and then taking it to POPLA.

Is the lack of ticket at the time and photographs using compact camera good grounds for appeal as well as citing the usual GPEOL statements?

The premises concerned is a parade of shops, to the left is a computer shop which is closed at weekends, in front a pet shop which closed for the days business shortly before the time the alleged incident happened, and to the right a vacuum cleaner repair shop which closes at lunchtime, so all these businesses were not deprived of any business or loss of income as they were not there to conduct business. There is a popular chicken based fast food outlet further to the left. The car was parked under 5 minutes.

There was a bloke on a motorbike loitering about. Hmm.

My first time at all this, as you can probably tell...

    Guess, Dereham Road, he rolls over with a strong challenge. Others will advise but I think he cannot use a handheld camera.

    Do a forum search on 'drive away KADOE' and read about the issues relating to hand-held camera shots of parked vehicles.

    Why not voice your concerns about the pictures to Trading Standards. As these picture are being used to charge for services they need to be pukkha.
    You never know how far you can go until you go too far.

    One organisation mentioned regularly in this sub-forum says to just ignore it and the colourful threat letters that may follow, but not sure that is wise.

    Quite prepared to make his life more expensive or difficult.

    To save you going through the threads here are the words you need to have in your back pocket. No need to alert an idiot that he is an idiot.
    Although, I examined a selection of these cases during my visit and was satisfied that there appeared to be sufficient evidence to support a request to DVLA being submitted in each of the cases examined I advise that all vehicles should be ticketed where ANPR technology is not utilised.

  • Update. Initial appeal letter was posted to NPE last week, so the ball is in their court - to either drop it, or be prepared to take it further which will cost them...
  • Update 2: Appeal letter was sent 1st week Feb. We're now in the 7th week following with no communication from them...
