    Right I've cocked this right up - followed everything to date to the letter with regard to charges.

    I've only then gone and got the date wrong on the actual court hearing *sigh*

    So basically on Sept 13th I didn't turn up to court!

    I honestly thought it was tomorrow - what should I do !?!?

    okay guys - slight twist here. RBS account was o/d by £4711. Asked for charges and they added to £3300. Put a claim in April for the charges. In themeantime got a bill from RBS for £145 - kept getting this letter and kept writing to ask what it was for. Then in May got a court summons for £294. Once again wrote saying what is this for (although it related to the above account number - could not work out the sum). They ignored it. Anyway put a defense in and turned up at court yesterday and found we had Judge Dudley at Southend Court - whom people had been saying was imposing stays on all claims. We walked into the chambers with all paperwork in hand ready for a battle (but still expecting to lose). The judge said that as RBS had made a claim but not come to support it - he was striking it off. Did not want to hear details of anything (was in the courtroom 1 minute). So my advice based on this is if you think you have a case and you need to attend - please try. This jugdge had obviously had it to the teeth with banks not turning up and therefore made his judgement accordingly. Keep going guys!

    Telephone the court and see what happened it may have been stayed pending a hearing in December or it may have been struck out.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    do you know what happened in court? dont have any idea what you can do but id explain to the court that you were violently ill on the day. was it a hearing on a stay or a proper get yer money type case?

    claimed/settled - Natwest £2,535/£2,535, HSBC visa £80/£80, MBNA £1,258/£1,258, capital one £282/£282, tesco visa £515/£515, HSBC visa £140/£140. HSBC £1,450 MCOL Stayed for OFT case. Chelsea Mortgage charges & cashback £5000/£672. complaints with banks pending OFT Halifax £30, A&L £35. TOTALS £11,325/£5482

    Right called them and said I was ill and it was unavoidable - the clerk told me that all cases are being stayed until December and was I aware that it is all pending the current test case going through the high court?

    Problem is, they took names and my name wasn't on that list :(
