Hi,
I hope I've put this in the right place!
I had an accident last year where I wasn't at fault - however unfortunately there were no witnesses so the other party/insurance company has come up with a story to make it my fault. After a lengthy wait, it's come down to my word against theirs, looking like it's ending up 50/50.
Because it's a small amount of damage, I won't be making a claim as my excess is £400 and I've been quoted £360 to repair it; plus I'm looking to sell the car most likely as a part exchange, so I'd probably not get it fixed at all. I'm also fairly certain that the damage to the other party was very minor, and she was a very young driver (I would guess 18) so her excess will be £500+; I would assume that she will be happy enough to get away with 50/50 and wouldn't claim either.
My question is, if neither of us claim, will I lose my no claims bonus simply because I was involved in the accident? I'm sorry if it's a stupid question, I would hope that, as there will be "no claim", my no claims would be in tact; but I was also naive enough to think that they would be honest about fault. Lesson learned: dashcam installed!

The accident has to be declared, whatever the eventual settlement outcome, for instance when a prospective future insurer asks on the application form, and the existence of it may load some policies very slightly even with the no claims bonus not affected.
As for what happens now, it sounds like you're a bit in the hands of how the other person's insurers handle it.0 -
NCD is only effected if your insurer has a net outlay. So if no one makes any claims for damages and your insurers havent engaged the services of any external experts then your NCD wouldnt be impacted but you'd still have to declare the incident.
If the TP does claim then your NCD will be impacted even if you dont claim.
As your repairs are below the excess you could still claim 50% of your repair costs from the third party insurer and that in itself wouldnt impact your NCD, though it may encourage the TP to do the same against your insurance which would0 -

You've explained this better than Aviva did, this actually makes sense now. So the third party are in the same boat as me, I would hope that they will not claim either (as if they do, I certainly will) leaving both our NCD in tact.
