Requesting statements after being removed from the account

I am trying to help a friend sort out a money dispute with her ex.

They had a joint account and we need to see the statement for it. Her name was removed from the joint account a year ago.

I understand you can request statements from the last 6 years, but is it OK to request statements from the time that you were a joint account holder?

The account was set up as a joint account newly and then she was subsequently removed.

"From the time" - does this mean for the time after her name was removed? If so, then the answer is obviously NO.

No sorry, just from the time that she was legally named on the account. We want to see the statements from when they both owned the bank account, but she is concerned that as she was removed, she won't be able to get them. I have told her to write to Barclays to request them from period x to period y (when she was named) and see but just trying to get an idea if this will go through.

it may be beyond the bank to separate those dates out; the correct way is for her to request the information as part of the other party's Form E declaration, via her solicitor.
The questions that get the best answers are the questions that give most detail....

    Thanks, I'll look into it.

This isn't part of a divorce, do the same rules apply? At present she has an appointment for a consultation with a solicitor. Her ex is claiming money owed for rent payments which she intends to prove she paid into a joint account. I don't know where it will lead, she is hoping to settle it with him and at least have proof in place if he tries to take her to court. So we're just trying to get hold of a record of money paid from her account to the joint account, which rent was paid from.

ah, sorry I did presume it was to do with divorce. This should be more straightforward.
She can get/ should have statements showing the payments leaving her bank account.
If she cannot persuade the bank to provide copies from the joint account for the period, she can always ask her bank to provide evidence of where the payments were sent to, just as one would if providing proof of payment to a company etc.

  • Surely the easiest way is to send a letter to the bank's Data Protection Unit, with a cheque for the statutory £10, asking for a copy of all information held by the bank, "including but not limited to statements for account 12345678 from the period X to Y".

Doing that will get you the information, but not the statements. The Data Protection Act doesn't oblige banks (or any other company) to provide the information in the same format as it was originally sent. You'll most likely get a long computer print out with all the details on it.

This would probably do, to be honest. All we want to see is how much rent and bills were paid from their joint account so we can work out how much she contributed towards the total.

A bank would not normally remove a name from a joint account in such circumstances. They will change an account from sole name to joint names but not the other way around.
More than likely the original joint account was actually closed.
