  • I'm not sure. They seem to think having the house as more valuable than anything else. He also seems to think that's how it works according to the law. Because he's staying in the house, she's entitled to a greater share of everything.
    I am fully aware it doesn't make a lot of sense.

    The buy from the estate approach makes the estate value fairly clear.

    There is value in the occupation but that is independent of the value of the estate at the date of death.

    Market rent is one way to value the occupation, but this is offset by the estate benefiting from the place being looked after the occupant should be liable for all the bills.

    He should consider being joint administrator and getting proper legal advice if this thinking is coming from the SIS driving the process/thinking.

    What sort of numbers are we looking at, house value, mortgage, rest of the assets(cash, banks etc.), house stuff(is he keeping all that stuff).

    Also what is your joint income/dependants this will determine if a mortgage is viable.
