Lloyds bank taken money without perm

Hi all, im just after a quick piece of advice if anyone could help me.
I have had credit card with Lloyds bank since 2001 and maxed it out but kept payments upto date until I missed a payment a long long time ago, I received a late payment letter to pay, I went the bank to pay only to realise I had made the payment, or so I thought, but what I noticed the month after was my bank transfered the payment over without my permission, (both bank acc and credit card are Lloyds) so without checking my statements I thought ok ill just keep it as it is and let them keep taking it at least its getting paid.
But having checked my recent statements after noticing the balance not goin down much I have seen that the credit card are taking the payment and still charging me a late payment fee therefore meaning im only paying £2.00 a month off the card, I have statements for at least the last 4yrs showing this,and they must have records of it being even longer.


So I have been getting intrest and a late payment fee added to the account for as long as I can remember, on the back of the credit card taking a payment from my silver account without my permission, what I want to know is can I reclaim any of this??

    Did you make any payments?

    If not, they may all be classed as late unless the payments from your current account were via Direct Debit.

  • You've just admitted that you never made any payments yourself, you just let the bank take it each month. You did give permission for Lloyds to take money from your bank account, check your T&C's. It's always advised to not debt and save/bank with the same lender.

    You could try and ask them that you genuinely didn't realise, you thought you had a direct debit. They might refund some as a goodwill gesture.

    Always double check that you've setup a direct debit in the future.
    Credit 'Score' - Don't buy the credit 'score' that Experian, Equifax and Noddle want to sell you. It's an arbitrary number that means nothing when it comes to applying for credit.

    ALWAYS HAVE A DIRECT DEBIT SET UP FOR THE MINIMUM PAYMENT ON YOUR CREDIT CARDS, REGARDLESS OF WHETHER YOU PLAN TO LOGIN AND PAY EACH MONTH.

    BIB: When Lloyds took said payment they were exercising "Right to Set Off."

    The bank has the right to offset funds from other accounts with them - but only if/after you have missed the contracted payment yourself.

    So if you don't pay yourself manually (or by DD) then your payment is late, and then they use the offset.

    It is a shame you didn't check your statements at all over the last 4 years as you could have taken action at that point.

    You could ask them to consider reimbursing some of the fees as a goodwill gesture.

    did you not notice this on each statement for 4 years?
    It sounds like you had no standing order or direct debit set up and were not making any payments yourself. The offsetting has meant that there has at least been some payment taken.
    You could say you were confused and did not realise this was not a direct debit but your statement should have shown whether there was a direct debit in place and, if so, it would have been taken before the due date not after/late
  • Did you not continue to get one default sum (late payment £12 fee) letter per month? If not, you likely have grounds for a complaint.

    Seems most people are in agreement that you haven't made any payments yourself.

    So no, I don't think you should get any refunds or money back if this is the case. You missed the payments, making them late, so you got charged a late payment fee.

    You can argue that the bank can't do that (yes they can), and that payments were made (they weren't made by you, the were deducted from your current account by the bank).

    Equally had Lloyds done nothing about taking payments for your credit card, you would have been defaulted for non-payment and further damage any credit worthiness you may have had.
