Faulty Kitchen Appliance - What to do next?

Long story short I had ordered an appliance for my kitchen. The first one arrived damaged (bent on the ends) and the second one which was delivered just before Christmas looked OK until we fitted it and noted the frame was "bowed".

Company who we purchased goods from (via Internet and on Credit Card) decided they would send Siemens out to inspect the appliance. At this point I already knew that the part was not repairable / replaceable as it was the same part that was damaged on the last unit hence why it was replaced.

So Siemens come out- inspected and said he can confirm that it is bent and goods were not repairable by himself and would submit a copy of his report for Siemens to forward to the company I purchased goods from.

Now the company I purchased goods from said that Siemens said I have damaged the goods when fitting and they would not replace.

Where do I stand? What is best? Small Claims Court?

    What was the appliance, how much did it cost?

    Can you prove that the "bend" wasn't caused by user damage?

    Speak to your credit card issuer.

    Under Section 75 of The Consumer Credit Act, they are equally responsible for performance of the contract.
    This does assume the thing cost over £100... did it?

    Tell the CC co that you are rejecting the goods because they do not conform to contract and you would like a full refund and the goods collected.

    The total cost of the purchase was £7,500 but the actual amount of the item which is defective is £1,350.

    In response to the other reply... Lets put it like this. To fit the extractor (Downdraft - so it sits inside the worktop) you have to lift it by the part which is now bent. You can not install it any other way.

    In addition to the above- the drivers when they dropped it off just left it laying on the floor with no support. When I left my old one I left it laying on some wood so the pressure was not placed causing it to bow!

    AND... They took my fittings with them (Which I still have not got) so cant even install it correctly because I have no fittings!
