non delivery saga

I ordered a wardrobe 4th Jan, delivery for the 15th. 5th Jan email informs me its at the courier and they will contact me within 3-5 business days. 13th I contact the seller, they tell me one of the parcels (it comes in two parts apparently) has not been scanned in at the delivery depot, and that is why they haven't called me to arrange for delivery. They ask the courier to search to no avail. My patience has worn out and I ask for my money back. ''Sure as soon as we receive our parcel back'' they say, ''Well I dont have it, speak to your courier' i respond. ''Oh we will'', one week later no refund and no parcel returned to seller and as the tracking doesnt show it being returned they will not return my money. I have begun a lenghty charge back through my credit card but i will effectively be out of pocket nearly £700. Where do I stand now?

How did you place the order... in a shop, online, mail-order?

Your right to refund is not dependent upon their receipt of the returned item. Until the goods are delivered they remain wholly responsible.
Their response seems unusual as I would expect most businesses to be aware of this. Was this a purchase from a business / online store or a personal sale?0 -
