Buying a new build - is the builder in breach of contract??

    Gooner I'm pretty sure from your other posts that I know which development you're buying on. We also got a long-stop date from them (luckily didn't need it) but we'd already decided that if it came to that then we would accept the delay rather than the opportunity to walk away - purely because the way prices have risen around here.

    Sounds like you're currently renting and your landlord has given you notice? I wouldn't normally advise this, but you do know that a Section 21 doesn't oblige you to actually leave? Not a nice thing to do I know, but maybe better than being homeless?

    Because the owners are moving back to the house so we had to be out by the end of feb regardless. All part of getting the builder to agree the completion date befor exchange. Bearing in mind it should of been completed in October/November

    And?

    HAVE YOU HANDED NOTICE IN? or have they given notice to you?

    If the former, unlucky.

    If the latter, dont move. let them get a court order. LL cant end a tenancy

    We agreed to buy a new build off plan last May, we were originally told completion oct/Nov.

    We were able to secure a long stop date from the builder (Taylor Wimpey) of end of February 2015 when we exchanged.

    We have now been advised that they will not meet thier obligation and will be delayed until sometime in March.

    For failing to keep to their contractual (legal) date what can I do. Can I ask for compensation ???

    Please help!

    I think it's reasonably clear that "We were able to secure a long stop date from the builder (Taylor Wimpey) of end of February 2015 when we exchanged." means "when we exchanged, we were able to secure a long stop date from the builder (Taylor Wimpey) of end of February 2015".
