popla appeal advice please

I have just received a copy of the evidence submitted by Care Parking in response to my POPLA appeal and am hopping up and down furious about it.

I guess I have probably missed my chance but can anyone advise if I have any opportunity to respond to their evidence or is it a simple case now of what I submitted against their submission?

In retrospect I feel that I didn't take enough time to put together my stuff - photos, maps etc and feel I may not have made my case sufficiently.

They on the otherhand they have submitted a load of photos of a carpark that I never even entered to prove their brilliant signage! I am so gobsmacked and furious at their cheek but really frightened that POPLA will have no idea of the layout of the car parking and will take their evidence at face value. They have obviously upped their game as the last 2 appeals against them reported on the forum were won beacuse they didn't submit anything, whereas for mine they have set out a counter claim against all my points.

Any help, reassurance or advice very gratefully received!

This is standard practice, that the PPC answers the appeal points you have made, you get a copy and have the opportunity to dismantle it point by point (aka rebuttal). This process only applies to POPLA appeals; those going to the 'rival' IAS are denied the opportunity to see (or rebut) the PPCs' assertions.

In terms of rebuttals, here are a couple of links with examples. I'm sure these will give you plenty of ideas on how to handle your case.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Many thanks Umkommas for speedy reassurance.

So do I wait then for POPLA to contact me and offer me the chance of rebuttal. The evidence submission has been sent by the PPC to POPLA and copied to me and I haven't received anything from POPLA

Despite all my worries and anxiety, POPLA upheld my appeal and instructed that the charge should be withdrawn.:j
    So relieved and pleased.
Massive thanks to those who responded to my queries and provided a lot of support and guidance Umkommas, Dee140157, Coupon-mad, Umkomaas and Welsh Exile. You do a fantastic job and it is really appreciated.
I just heard from a friend that she got a ticket while shopping in her local Aldi the other week and have told her "DON'T PAY" and look here - at the stickie newbie thread first of course:).
    Thanks again

    Well done, excellent outcome!

Now, please do us a favour and tell all your friends about the private car park 'management' charade, the business model of which is principally aimed at issuing penalties to motorists and relieving them of eye-watering amounts of money. As you now know, they can be seen off with help from the forum.

Use Facebook and Twitter to tell your friends, and ask them to pass on the message to their friends. The more people know, the more sense we can knock into this system.
