O2 Faulty iPhone - 5 replacements

Hi everyone,

In 2012, I purchased an iPhone 5 on contract with O2, which held a duration of 24 months.

Over these 24 months I have had 5 replacement iPhones due to hardware faults, all have been replaced through Apple and I have kept all the service/repair logs as proof. Whenever I went to an O2 store with a problem they directed me to Apple for a repair. I know my contract is with O2 but I would rather have dealt with Apple at the time due to there great customer service and O2's lack of it.

My contract has now ended with O2 and the phone I currently possess is still having issues.

It was originally for an iPhone 5, where I had 3 replacement devices until Apple offered me an upgrade to an iPhone 5S as a gesture of goodwill, which was also faulty and ended up being replaced.

If I took O2 to a small claims court and showed the court the evidence of my repairs, would I be able to gain any compensation back or even a refund?

Even though the contract with O2 is over now, they essentially told me to get lost and speak to Apple about it and 5 faulty phones would perhaps imply 'not fit for purpose'.

What is everyone's thoughts on this?

    I've had an iPhone 5 from new, and it has been faultless.

    Even if they were found to be liable, the best you would be looking at is a proportionate refund, and of course you'd have to give the phone back. I wouldn't waste my time.
  • I don't think they are liable, mostly because all though they were technically the retailer you got the phone through you never actually had the problem resolved through them as you went to Apple.

    What is wrong with your phone? I have never known anyone have that many faulty iPhones! Your best bet, in my opinion, is to go to an Apple store and kick up a fuss and see what they do.

    SOGA lasts longer than 12 months but as you have received the repairs/ warranty / replacement from other than the vendor then you may have a problem .
    Be interesting to know what the problems have been .

    I'd be more interested in knowing what OP is doing to these phones, iPhones are not perfect but come on if you've had 3 iPhone 5 and 2 iPhone 5s's all break due to the same problem you must be doing something wrong! Or perhaps OP is just playing on Apples goodwill and hoping they give an iPhone 6 as another gesture of goodwill?

  • I don't believe you have any claim with o2 as you no longer have the phone they supplied you with.

    Not awful advice really, Apple are known for sometimes going above and beyond for customers so it could have offered a way forward for the OP. Whether that is fair on Apple or not is a different matter, but they are free to refuse - it's not going to harm anyone in trying.
