As I understand it, markers on the ground do tend to mark where the boundaries are and there seem to be certain legal assumptions, eg that where the marker is a hedge that the boundary is at the halfway point inside that hedge and also there is another legal presumption if there is a drainage ditch there as to where the boundary lies for instance.
But, if that wall has been there many years (as it would appear it has) then that is the boundary by now to all intents and purposes I would say.
I still think "clever duck" :cool: knows this. He describes the land himself as being a "public footpath". Looks like a try-on to me and he is sounding out our opinion as to whether he could get away with it.0 -
Not at all.
The wall was put in before we moved in, but not too long ago according to the previous owners.
It is public walkway but it's a lot more wide this end than the top end, so wanted to know if we have the same land as them on the other side.
I presume the previous owners left more of a gap on the public walkway so they can get a car up and park it out the back as there is a sort of drive at the back too..0
