Freeholder responsibilities

Hi

We need to get pointing done on our property and we are the freeholders for ours and the flat above.

Do we need to do the other flats pointing as well as ours as a freeholder?

Is the leaseholder required to split the costs with us as freeholders for arranging and carrying out the work? Or is this completely our responsibility and we have to pay for our and their property?

    I guess there are many ways you can proceed, including:

    1) Informally agree with the upstairs neighbours to re-point the whole building and split the cost.

    or...

    2) As freeholders, check the neighbour's lease to ensure they have a duty to contribute to building repairs. Then initiate a Section 20 consultation process in respect of re-pointing the whole building, to ensure they pay their share (assuming their share will be over £250).

    or...

    3) As leaseholders, ask the freeholder's permission (i.e. ask yourself permission) to re-point just your part of the building - and cover the costs yourself.

    If it needs doing, it would be stupid not to do it all. Because if there is severe damage at some stage then you would (most likely) still need to pay half of the bigger bill

    As I can't read the leases in question from here I have no idea what your responsibilities as freeholder are.

  • Have read the lease it says we are solely responsible for the foundation of the building and have to insure both properties. They are responsible for the roof.
