    OP ... I'm not being picky but you keep referring to 'our' claim and 'we'.
    this is not a joint claim, it is solely your husbands claim.
    if you wish to claim income related ESA, it will them be a joint claim.
    the fact that you work 23 hours a week would make this possible, but it is dependable on your income.

    i would phone ESA either way to chase up his assessment

    sorry, yes at the moment, it's just his claim. Will also be appealing the PIP decision. I am wondering if on the PIP assessment, the 'washing and bathing unaided) has been an oversight. Briefly, due to a trapped nerve and subsequent nerve damage he has lost the use of his left hand. Some of the descriptors, such as preparing a meal (he is unable to peel or chop a potato, for instance), cutting up food, needs assistamce with dressing (cant put his socks on, cant fasten a trousers button and belt) have been awarded points, yet on the washing and bathing one, aside from obvious difficulties, he cannot grip the handgrips to get out of the bath and cannot hold the grip rail in the shower so he does need help yet this has not been awarded points. His hand is permanantly clawed so even washing his hands is a challenge

    Based on a current earned income of £149.50pw you wouldn't be entitled to income based even with your partner on the assessment period of ESA (£72.40)

    Although if you have a mortgage this may then give an entitlement to housing costs after a 13 week period (possibly may be backdated) and will require a call to ESA to request an ESA3 form.

    If you rent you should apply for Housing Benefit and there's a small entitlement to Council Tax Support.
    Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.
