I've sent an initial query to the management company to ask why they never picked up on/made the owners aware of the lease issue - which seems to have happened just before or around the time they bagan to manage the property - does anyone have a view as to if the management company have any liability for this situation?

I am right in thinking that you pay an external company to be the Management Company rather than have the leaseholders form a Limited Company and self manage?

I wouldn't thought that they have anything to do with your Leasehold. Usually they collect the service charge, pay the communal cleaning/maintenance bills, file the accounts and pay any tax. None of that involves the Freeholder.

I would be careful about going down that road with them. It could be equally be said that for 4 years none of the 7 leaseholders raised the fact no ground rent was being collected. Whilst saving them money it was an early indication that something was amiss.

I'd have thought owning the lease to your flat would only add value, if not certainly sale-ability, plus getting it all done for 2k sounds like a bit of a bargain to me.
