Oil Boiler installation mistake

I am looking for some independent advice/opinions please. I am a landlord, and had a new replacement oil condensing boiler installed in a property in October 2012. It was installed by a professional company, who stated they installed oil boilers, although I later discovered he was gas registered, but not OFTEC registered. I know installers who are not registered, get a registered OFTEC engineer to sign off the work, so I wasn't concerned. The boiler was serviced for the first time in December 2014 by a different company. They discovered that the copper oil pipe in and the rubber exhaust pipe had been put on the wrong way round. They have told the tenant this would use considerably more oil and could have flooded oil.
The tenant is not pleased, particularly with the historic price of oil over the past couple of years, and wants some reimbursement. I totally agree with the tenant, and think the installation engineer should be held responsible and liable to pay some compensation to the tenant.
What I want to know is: Is it a legal requirement for a replacement boiler to be checked by an OFTEC registered person?
What other complications could this error have caused
Any other comments or advice of what I should do
I haven't contacted the installer yet, but I have asked the service engineer to do me a report stating the facts.

If that was the case the boiler simply would not work0 -
OK, thanks. Perhaps I have misunderstood. I'm waiting for a report from the service engineer so hopefully that will clarify the details rather than rely on a third party explanation from the tenant. I'll post back here when I have more info.0
