    What would be the advantages of serving the S8? As far as I can tell it means a) the landlord is not guaranteed posession and b) the tenant would not get rehoused. The objective at this point seems to be to evict the tenant?

  • s8 if granted by judge also comes with judgement on rent owed. Much easier for council to understand eviction reasons

    Therefore making it far more complex than it should be, just because he loves councils and everything they do.

    S21 is the way to go.

    You don't say how far through the contract the tenant is, so perhaps the agents were talking about serving a S8 with a view to getting her out quicker? It seems (from my brief knowledge) that it can be served at any time and you have to give less notice? I don't know how much it costs but it might be worth a shot to get her out quicker (whilst also serving the S21 as a backup)?

    Edit: I would clarify with the letting agents - when was the deposit taken? When was it protected? When was the prescribed information sent? What notice are they planning to serve (S8 for rent arrears or S21) and on what grounds (S8 has different grounds) ? What action have they so far taken with regards to the rent arrears? Have the written to her? Have they enclosed an upto date rent statement?

    I do not love councils & everything they do: I particularly dislike it when councils end up having to waste their time & money on non-paying evicted tenants because landlords (I am a landlord btw, been one for 10+ years..) don't help the council save money by evicting using s8 or ensuring council know about & see evidence of rent arrears: Nor do I like or love paying more council tax than I need to because of such scr*at tenants and landlords.

    Councils have many other faults: Democracy is a terrible system but I don't know a better one.
